REGISTRATION

Registration for all Programs is through the online email and store system on the Marine One Solutions’ website. For all programs, full payment must be received via online store or in person to begin e-learning courses and secure your spot in the confined/open water sessions. The exception is for private trainings.

REGISTRATION CHANGES, REFUNDS & CANCELLATION

Marine One Solutions, LLC reserves the right to cancel a program at any time, for any reason. If a program must be cancelled, you will be notified via the email you provided upon registration. Your registration fee will be transferred to another program or refunded.  Under no circumstances will a refund be issued once a the in water portion of a program has begun. It is the responsibility of the registered student or parent/guardian to ensure medical clearance to conduct the in water sessions prior to the first confined water session. Medical forms will be sent with the e-learning codes to allow time for physician sign off if necessary. If the student can not proceed due to unforeseen medical issues and  deemed unfit to dive by licensed physician, prior to the first confined water session, a partial refund may be issued. If you must change your registration to another available session, please contact Marine One Solutions, LLC directly. If you must cancel your registration, your registration cost will only be refunded if Marine One Solutions, LLC is able to find a replacement for your seat in the course.

DIVE TEAM MEMBERSHIP

Dive team membership is a subscription based scuba training program. Monthly or annual payments are accepted. Subscription includes access to Monthly training of approximately 2 hours in length. Members may not all train on the same day, however the training curriculum will remain for the scheduled month. Training program will be shared via the member portal. All Members will be given a MOS T- Shirt at no cost to the member. Discounts for members will be capped at 15% with use of special code. Discount code applies only to MOS gear or Training. Other discounts will include a 15% discount rate for gear rental. Subscription will include one lake phoenix entry fee when used on a lake trip with MOS Staff. Lake trips will be planned throughout the year. Subscription includes one annual scuba refresher with e-learning code and given after 9 months of consecutive membership. Every effort will be made to update the training schedule and the schedule for annual refreshers. It is the responsibility of the members to know the schedule and attend the trainings. Make up dates will be attempted, however there are no guarantees of additional dates. Life support systems (BCD, Regs Computers, Tanks,) will be provided free of charge during training while supplies last. Memberships may be cancelled at any time. Annual membership cancellation will be refunded at a prorated monthly rate. Must be an Open Water Certified Diver to join. Proof of C-card will be provided via email, or in person on first training day.

CONDUCT & BEHAVIOR

Marine One Solutions, LLC staff reserves the right to dismiss, without refund, any participant whose behavior, including but not limited to bullying, foul language and reckless or irresponsible actions, affects the well-being, enjoyment and/or safety of others.

WEATHER

Programs occur rain or shine and we plan to be on the water in a variety of weather conditions. In the event of lightening or other dangerous weather Marine One Solutions and participants must comply with their partner locations restrictions due to weather. Marine One Solutions, LLC staff will take into consideration any weather threats and determine if it is safe to conduct the dive. Your MOS instructor has full capability to halt or cancel instruction based on weather conditions. We will make every attempt to reschedule private lessons and courses should we need to cancel based on weather or our partner facilities. Keep in mind that the weather is changeable; as such, please dress and be prepared for a variety of weather conditions.

SAFETY

Marine One Solutions’ goal is to provide a safe and enjoyable learning environment. Participants shall follow instructions given by instructors and use their own best judgement to maintain their personal safety. Participants shall not engage in any behavior that puts themselves or others at a safety risk. Participants must stay in close proximity and follow their dive instructor(s) during their in water sessions. Medical waivers must be completed prior to the first confined water session.

LOST, STOLEN OR DAMAGED ITEMS

Marine One Solutions, LLC is not liable for any lost, stolen or damaged items.

AGENCY

Marine One Solutions, LLC may make any changes to these policies at any time pending approval by Geoffrey Phillips or Antonio Barrera.

RELEASE OF LIABILITY, PROMISE NOT TO SUE, ASSUMPTION OF RISK AND AGREEMENT TO PAY CLAIMS

By participating in Marine One Solutions, LLC programs, trainings, activities or events, you agree to the following:

I understand and acknowledge:

a. that these activities, by their very nature, pose the potential risk of serious injury/illness to individuals who participate.

b. (b) that in order to participate in these activities, I agree to assume liability and responsibility for any and all potential risks which may be associated with participation by me or my dependents in such activities,

c. (c) that Marine One Solutions, LLC, its employees, officers, agents, or volunteers shall not be liable for any injury/illness suffered by me which is incident to and/or associated with preparing for and/or participating in the activity (ies), Nor shall Marine One Solutions LLC,  its employees, officers, agents, or volunteers be liable for damage to individual equipment.

d. (d) that photos and/or videos of me and/or my child/ren participation in these activities may be taken for the purpose of assisting in the instruction and/or promotion of future programs

e. (e) I or my dependent/s have no known medical condition which may pose a risk to the health and safety of me, my dependent/s or others by participating in the registered activity(ies)

In consideration for being allowed to participate in this Activity, on behalf of myself and my next of kin, heirs and representatives, I release from all liability and promise not to sue Marine One Solutions, LLC and its employees, officers, directors, volunteers and agents (collectively “Marine One Solutions, LLC”) from any and all claims, including claims of the Marine One Solutions LLC negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in this Activity, including travel to, from and during the Activity.

I am voluntarily participating in this Activity. I am aware of the risks associated with traveling to/from and participating in this Activity, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to travel; or the condition of the Activity location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Activity, including travel to, from and during the Activity. I agree to hold Marine One Solutions, LLC harmless from any and all claims, including attorney’s fees or damage to my personal property, that may occur as a result of my participation in this Activity, including travel to, from and during the Activity. If the University incurs any of these types of expenses, I agree to reimburse Marine One Solutions LLC. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.

I am 18 years or older. I understand the legal consequences of agreeing to this document, including (a) releasing Marine One Solutions LLC from all liability, (b) promising not to sue Marine One Solutions LLC, (c) and assuming all risks of participating in this Activity, including travel to, from and during the Activity. I understand that this document is written to be as broad and inclusive as legally permitted by the State of Virginia. I agree that if any portion is held invalid or unenforceable, I will continue to be bound by the remaining terms. I have read this document, and I am agreeing to it freely. No other representations concerning the legal effect of this document have been made to me.

IF PARTICIPANT IS UNDER 18 YEARS OF AGE:

I am the parent or legal guardian of the Participant. I understand the legal consequences of signing this document, including (a) releasing the University from all liability on my and the Participant’s behalf, (b) promising not to sue on my and the Participant’s behalf, (c) and assuming all risks of the Participant’s participation in this Activity, including travel to, from and during the Activity. I allow Participant to participate in this Activity. I understand that I am responsible for the obligations and acts of Participant as described in this document. I agree to be bound by the terms of this document.

By partaking in any Marine One Solutions LCC program or activity, you are agreeing that you have read these documents in their entirety, and you are agreeing to them freely. No other representations concerning the legal effect of this document have been made to you.
